Do you know the Notice on Simplifying the Relevant Policies of VAT Rates (CS [2017] No. 37) issued by the Ministry of Finance and the State Administration of Taxation on April 28?
According to the requirements of this latest document, from July 1, 2017, the VAT rate structure will be simplified, the VAT rate of 13% will be abolished, and the export tax rebate rate of 13% will also be abolished. Well, from this September, the export tax rebate rates for these commodities have changed.
The time of change in the export tax rebate rate
According to Article 3 of Circular No. 37, the applicable export tax rebate rate for export goods shall be defined by the date of export indicated on the customs declaration form for export goods. The time cut-off point for the change of export tax rebate rate is August 31, 2017.
The range of changes in the export tax rebate rate
According to Article 2 (2) of the Provisional Regulations of the People's Republic of China on Value-Added Tax, the commodities subject to the 13% VAT rate mainly include the following:
1. Grain and edible vegetable oil;
2. Tap water, heating, air conditioning, hot water, coal gas, liquefied petroleum gas, natural gas, biogas, and coal products for residential use; 3. Books, newspapers and magazines;
4. Feed, fertilizer, pesticide, agricultural machinery, agricultural film;
5. Other goods specified by the State Council.
After the abolition of the 13% tax rate, the VAT rate of some of the above-mentioned commodities has been changed to 11%, mainly including the following categories: agricultural products (including grain), tap water, heating, petroleum liquefied gas, natural gas, edible vegetable oil, air conditioning, hot water, coal gas, residential coal products, edible salt, agricultural machinery, feed, pesticides, agricultural films, fertilizers, biogas, dimethyl ether, books, newspapers, magazines, audio and video products, and electronic publications.
At the same time, the VAT export tax rebate rate has also been adjusted from 13% to 11%, and the specific types of goods and their related commodity codes can be downloaded from the corresponding list in the "Document Express" at the end of the article.
How to implement the change in export tax rebate rate
For foreign trade enterprises exporting the goods listed in "Annex 2" of this notice before August 31, 2017, the export tax rebate rate applicable to their business shall be determined according to the tax rate at the time of purchase, and if the VAT has been levied at the rate of 13% at the time of purchase, the export tax rebate rate of 13% shall be implemented; If the VAT has been levied at the rate of 11% at the time of purchase, the export tax rebate rate of 11% shall be implemented.
For the export of goods listed in Annex 2 of this notice before August 31, 2017, the export tax rebate rate applicable to its business shall be determined by its export time, and the export tax rebate rate of 13% shall be implemented for the export of goods listed in Annex 2 of this notice before August 31, 2017. The time of export of goods shall be carried out in accordance with the export date indicated on the customs declaration form of export goods.

1. The "Customs Commodity Code" module inquires about the change of tax refund rate and other information
(1) It can be seen that the name of the commodity, the tax rate and the tax refund rate are all 13%, the starting date is January 1, 2017, the termination date is June 30, 2017, and the document implementation date is July 1, 2017.
(2) It can be seen that the name of the product, the tax rate and the tax refund rate are all 11%, and the starting date is July 1, 2017, and the date of implementation of the document.
Therefore, after the implementation date of the document, after July 1, 2017, the name of the declared commodities in the system has been changed from "other dried and salted cuttlefish and squid originally taxed at 13%" to "other dried and salted cuttlefish and squid taxed at 11%", and the corresponding tax refund rate and tax rate have been reduced from 13% to 11%.
2. In the modules of "Export Detail Declaration Data Entry" and "Purchase Detail Declaration Data Entry", it can be compared that the export date is before and after August 31, 2017, and the documents involve changes in the tax rebate rate of commodities.
(1) When the 13% VAT special invoice obtained with the export date of 2017.08.31 is declared for tax refund, the tax refund rate is still 13%.
(2) When the 13% VAT special invoice obtained with the export date of 2017.09.01 is declared for tax refund, the tax refund rate is 11%.
September has begun, the time node of the export date August 31, 2017 has passed, the tax rebate rate of goods involved in the documents will be adjusted to 11%, if the export of the original documents after August 31, 2017 involves the 13% levy rate of goods VAT invoice, the tax refund rate will be changed to 11%.
